APPENDIX A. STATEMENT OF COMMISSIONER LAPHAM ON SECRECY AGREEMENTS
If this recommendation is adopted, it will inevitably gut the secrecy agreement that is
currently required as a condition of CIA employment. The report suggests that the
broad-form prepublication review provision contained in this agreement has no value,
because the malicious will disregard it anyway and the conscientious can safely be held to
a less broad requirement. I do not believe that the historical record supports this
suggestion, and I am mindful of the fact that DCIs have repeatedly affirmed, with
reference to the current agreement or its predecessors, that the broad-form prepublication
review provision is vital to the protection of intelligence sources and methods.
I do not believe that this recommendation should be adopted, if at all, without a much
fuller accounting of the benefits that have been realized as a result of the obligations
imposed by the CIA secrecy agreement, and the risks that would ensue if that agreement
were to be modified in accordance with the recommendation.
